These Booking Terms & Conditions apply to all bookings made directly with Exclusive Escapes Pty Ltd (ACN 676 766 331) (trading as Margaret River Properties Australia) (“Margaret River Properties”, “we”, “us”, “our”) via our website.

By making a booking, the lead guest confirms they have read, understood, and agree to be bound by these terms on behalf of all guests in their party.

Bookings made via third-party platforms (e.g. Airbnb, Booking.com, Stayz/Vrbo) are governed by the terms of the relevant platform, supplemented by these terms where they do not conflict.

Relationship to Hometime Guest Terms & Conditions:

These Booking Terms & Conditions supplement the Hometime Guest Terms & Conditions, which apply to all bookings across all Hometime brands. The Guest Terms & Conditions cover platform use, guest eligibility, guest responsibilities, pets, damage and dispute resolution, liability, indemnity, privacy, complaints, intellectual property, and force majeure. Where there is any inconsistency between the Guest Terms & Conditions and these Booking Terms & Conditions, these Booking Terms & Conditions prevail to the extent of the inconsistency.

1. Our Role

Margaret River Properties acts as the booking and management agent for the owners of the properties listed on our website, and as merchant of record for payment processing on the owner’s behalf. The contract for your stay is formed between you (the lead guest, on behalf of all guests in your party) and the owner of the property, with Margaret River Properties acting on the owner’s behalf in arranging and managing the booking.

The property owner is the principal and is responsible for the property, including its condition, presentation, compliance with applicable laws, and the provision of the accommodation as described in the listing. Margaret River Properties’ liability under or in connection with your booking is limited to its role as agent and to its own acts or omissions. Except where liability cannot be excluded by law, Margaret River Properties is not liable for the acts or omissions of property owners.

2. Booking & Lead Guest Responsibility

  • The person making the booking (“lead guest”) must be at least 18 years of age and must be staying at the property for the duration of the reservation.
  • The lead guest is responsible for the conduct of all guests and visitors at the property, and for ensuring all guests comply with these terms and the property’s house rules.
  • The total number of guests staying at the property must not exceed the maximum occupancy stated on the listing. Children and infants are included in this count unless otherwise specified.
  • All guests must be disclosed at the time of booking. Hosting additional guests not on the reservation is not permitted without prior written approval from Margaret River Properties.
  • Margaret River Properties reserves the right to refuse a booking, or cancel a confirmed booking, where information provided is incomplete, inaccurate, or where we have reasonable grounds to believe the booking does not align with these terms.
  • All guests are required to complete our guest app and acknowledge these Booking Terms & Conditions and the Hometime Guest Terms & Conditions prior to check-in. This is a requirement of all bookings to comply with our merchant of record obligations. Failure to complete the guest app may result in delayed or denied access to the property. Cancellations resulting from non-completion remain subject to the cancellation policy in Section 4. 

3. Payment Terms

  • A valid credit card is required at the time of booking to secure the reservation. Payments can also be made via bank transfer.
  • A non-refundable deposit of $100 is charged at the time of booking to confirm the reservation.
  • 50% of the total reservation amount is charged 60 days prior to the check-in date. Once taken, this payment is non-refundable.
  • The remaining balance is charged 30 days prior to the check-in date. Once taken, this payment is non-refundable.
  • For bookings made within 60 days of check-in, the $100 deposit and 50% payment are charged at the time of booking, with the remaining balance charged 30 days prior to check-in. For bookings made within 30 days of check-in, the full reservation amount is charged at the time of booking. All payments are non-refundable.
  • If payment fails on the scheduled charge date, Margaret River Properties will attempt to contact the lead guest to resolve the issue. If payment cannot be processed within 48 hours, the booking may be cancelled and the cancellation policy below will apply.
  • All prices are quoted in Australian Dollars (AUD) and include GST where applicable. Cleaning and linen are included in the nightly rate. Any additional fees (e.g. extra services, late check-out where available) will be disclosed prior to confirmation.
  • Margaret River Properties reserves the right to correct pricing errors. In the event of a clear pricing error, we will contact the guest to either confirm the corrected price or cancel the booking with a full refund. 

4. Cancellation & Refund Policy

  • Cancellations made more than 60 days prior to the check-in date will forfeit the $100 booking deposit only; no further amounts will be charged.
  • Cancellations made between 30 and 60 days prior to the check-in date are non-refundable, as the 50% payment has been taken in line with our payment terms.
  • Cancellations made within 30 days of the check-in date are non-refundable, as full payment has been taken in line with our payment terms.
  • If a guest checks in and chooses to leave early, no refund will be issued for nights not stayed.
  • No-shows are treated as cancellations and the applicable refund policy applies based on the date of the scheduled check-in.
  • Date changes are treated as a cancellation and rebooking, and are subject to the cancellation policy above. Any change is at Margaret River Properties’ discretion and subject to availability.
  • We strongly recommend all guests take out comprehensive travel insurance to cover unforeseen circumstances, including illness, travel disruption, and changes to plans. 

5. Security Deposit

  • A pre-authorisation hold will be placed on the lead guest’s nominated credit card prior to check-in as security against damage, breach of these terms, excessive cleaning, or any additional charges incurred during the stay. The amount of the pre-authorisation will be disclosed at booking confirmation and may vary by property.
  • The pre-authorisation is not a charge. Where no charges arise during the stay, the hold is released following check-out, subject to the bank’s processing timeframes.
  • Margaret River Properties will provide a written summary of any charges before processing payment, where reasonably practicable. 

6. Check-in & Check-out

  • Check-in and check-out times vary by property and are stated in the booking confirmation and listing.
  • Early check-in and late check-out may be available on request and are subject to availability and operational requirements. Additional fees may apply.
  • Check-in instructions are provided prior to arrival. Guests may be required to provide identification and complete a check-in form. 

7. House Rules

Parties & Events

  • No parties or events are permitted at any property unless prior written approval has been granted by Margaret River Properties.

Noise

  • Guests must treat neighbours with respect by keeping noise to a minimum. Guests must comply with all applicable local council regulations, including maintaining quiet hours between 10:00 PM and 7:00 AM.

Smoking

  • Smoking is prohibited inside the property. Smoking is only permitted in designated outdoor areas where provided, and all cigarette butts must be disposed of responsibly.

Pets

  • Pets are welcome only in designated pet-friendly properties. Guests must notify Margaret River Properties at the time of booking if they plan to bring a pet.
  • Pets must not be left unattended at the property.
  • Any damage or extra cleaning required due to pets will be charged to the guest.
  • Failure to notify Margaret River Properties about pets may result in the cancellation of the booking without refund.

Property Security

  • Guests must ensure the property remains secure during their stay by locking doors and windows when not in use.

Cleaning & Departure Condition

  • The property must be left in a reasonably clean condition upon departure. Guests must clean up after themselves, including washing and packing away dishes, cleaning the BBQ if used, and removing all rubbish and recycling to designated bins. 

8. Breach of Terms & Right to Evict

  • Margaret River Properties reserves the right to terminate a booking and require guests to vacate the property immediately, without refund, in the event of a breach of these terms or the house rules. Breaches include but are not limited to: hosting an unauthorised event or party, exceeding maximum occupancy, smoking inside the property, hosting unregistered guests, bringing unapproved pets to the property, anti-social behaviour, or causing wilful damage.
  • In the event of eviction, guests remain liable for any damages, additional cleaning, and any costs incurred by Margaret River Properties as a result of the breach.

9. Governing Law

These Booking Terms & Conditions are governed by the laws of the State of Western Australia, Australia. Any disputes will be subject to the non-exclusive jurisdiction of the courts of Western Australia.

For all other terms governing your booking, including liability, indemnity, damage disputes, privacy, complaints, and force majeure, refer to the Hometime Guest Terms & Conditions.
